<p>But not everyone believes Apple is playing by the rules of law. While rich with products used by millions the App store is where the question of impropriety has been leveled against the Cupertino CA, based corporation. Today in the Supreme Court, Justices listened to the case of <a href="https://www.supremecourt.gov/oral_arguments/argument_transcripts/2018/17-204_32q3.pdf">Apple Inc v. Pepper</a> <a href="https://www.supremecourt.gov/oral_arguments/argument_transcripts/2018/17-204_32q3.pdf">(read today&#8217;s transcript)</a> and will now decide if App store business practices violate Anti-Trust regulations.</p>
<p>While we won&#8217;t know until well after the Holiday&#8217;s how the Scotus Justices will rule, we&#8217;re sure many readers will still enjoy their own Apple products during this gift giving season.</p>

<p>Illinois Brick Co. v. Illinois, 431 U.S. 720 (1977) and its progeny hold that the damages remedy in antitrust disputes belongs only to the immediate victims of the anticompetitive conduct (&#8220;direct purchasers&#8221;), and not to downstream parties claiming &#8220;pass-through&#8221; damages (&#8220;indirect purchasers&#8221;). Electronic marketplaces such as Apple&#8217;s App Store present a new wrinkle on this doctrine, because the marketplace sponsor (e.g., Apple) interacts with and delivers goods &#8220;directly&#8221; to consumers, but as an agent on behalf of third party sellers.</p>
<p>The district court dismissed this action under Illinois Brick, holding that consumer plaintiffs alleging monopolization of distribution services Apple provides to app developers were necessarily seeking pass-through damages. The Ninth Circuit reversed, holding-in an acknowledged split with the Eighth Circuit-that consumers can sue whoever delivers goods to them, even if they seek pass-through damages.</p>
<p>The question presented is:</p>
<p>Whether consumers may sue for antitrust damages anyone who delivers goods to them, even where they seek damages based on prices set by third parties who would be the immediate victims of the alleged offense.<br />

Palmieri, Judge of the United States District Court for the Southern District of New York, from 1959–1961. From 1961–1963, she was a research associate and then associate director of the Columbia Law School Project on International Procedure. She was a Professor of Law at Rutgers University School of Law from 1963–1972, and Columbia Law School from 1972–1980, and a fellow at the Center for Advanced Study in the Behavioral Sciences in Stanford, California from 1977–1978. In 1971, she was instrumental in launching the Women’s Rights Project of the American Civil Liberties Union, and served as the ACLU’s General Counsel from 1973–1980, and on the National Board of Directors from 1974–1980.
